We respect the work of artists and rights holders. If you believe something on this site uses your copyrighted work without permission, here’s how to let us know.

1. Where We Stand

We don’t want to sell anything that infringes someone else’s copyright. If you believe a product, image or any other material on pokimerch.com infringes a copyright you own, please send us a notice as described below. Notices are handled according to 17 U.S.C. § 512, part of the Digital Millennium Copyright Act (DMCA).

2. What Your Notice Must Include

Please send your notice in writing, with all of the following:

• Your physical or electronic signature, as the copyright owner or as someone authorized to act for the owner.
• A description of the copyrighted work you believe has been infringed.
• The URL of every page on our site where the material appears.
• Your full name, mailing address, phone number and email address.
• Your good faith belief, stated in writing, that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.

3. Where to Send It

Mail notices to Pokimerch — Attn: Copyright Agent, 500 Valley Stream Dr, Newark, DE 19702, United States, or email [email protected]. Please put “DMCA Notice” in the subject line so it reaches the right place.

4. What We Do Next

We go through every complete notice within 5 business days. If the material appears to infringe, we take it down or disable access to it, and if someone else supplied it, we let them know.

5. Counter-Notice

If you think material was taken down by mistake, you can send us a counter-notice. It needs your physical or electronic signature; a description of the material that was removed and where it appeared before it was removed; and a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. Please also give your name, address and phone number, and state that you agree the federal district court for the judicial district where your address is located has jurisdiction (or, if your address is outside the United States, any judicial district in which Pokimerch may be found), and that you will accept service of process from the person who sent the original notice or that person’s agent.

6. Repeat Infringers

If a party is found to infringe again and again, we remove their material and stop working with them.

7. False Claims

Section 512(f) of the DMCA makes anyone who knowingly and materially misrepresents that material is infringing, or that it was removed or disabled by mistake, liable for damages, including costs and attorneys’ fees.
